These Terms of Use govern your access to Gradovia Learning and your purchase or use of its resources, guides, ebooks, practice materials, and courses. By using the website or placing an order, you agree to these Terms and our Privacy Policy and Refund Policy.
1. Owner and contact
Gradovia Learning is owned and operated by Luis Ernesto Nodal, a sole proprietor located in Miami, Florida, United States. Contact: contact@gradovialearning.com.
2. Adult-managed use
You must be at least 18 years old and legally able to enter a contract to create an account, submit a form, join a waitlist or community list, or make a purchase. A parent or legal guardian must create and control every family account and is responsible for activity under that account.
Children may use learning materials only with the permission and supervision of a parent or guardian. Children must not create accounts, purchase products, or submit personal information. A parent may create a limited student profile using a nickname, grade band, and optional PIN, but must not enter a child’s legal name, email, date of birth, address, phone number, school, photograph, or other identifying information.
3. Accounts
You agree to provide accurate adult account and billing information, protect your password, and notify us promptly of suspected unauthorized access. You are responsible for activity conducted through your account. We may suspend access when reasonably necessary to protect the account, the website, or other users.
4. Educational purpose
Gradovia Learning provides supplemental educational materials. Unless a specific product page expressly states otherwise, the service is not a school, tutoring contract, accredited institution, certification provider, or substitute for professional educational, legal, medical, or other advice. We do not promise a particular grade, test score, admission result, credential, or learning outcome.
5. Orders, prices, and payment
Prices and product availability appear on the relevant catalog or product page and may change before purchase. You authorize our payment providers to charge the amount shown at checkout, including any applicable tax. An order is accepted when payment is approved and access or delivery is confirmed. We may cancel and refund an order affected by pricing error, suspected fraud, duplicate processing, product unavailability, or another material problem.
6. Digital-product license
Unless a product page states otherwise, purchasing or downloading a resource gives the adult purchaser a limited, personal, non-exclusive, non-transferable license for educational use within that purchaser’s household. Ownership and copyright are not transferred. You may print reasonable copies for your own household but may not resell, redistribute, publicly post, upload to shared drives or platforms, remove ownership notices, reproduce for a class or organization, or create competing products from the material without written permission.
7. Free resources and previews
Free resources remain protected by copyright and are subject to the same personal-use limits unless a separate license is displayed. “Coming Soon” descriptions, previews, estimated dates, and waitlists are informational and do not guarantee that a product or course will launch on a particular date.
8. Refunds and delivery issues
Digital products and course access are generally final sale once delivered or made available. The complete rules, limited exceptions, and support process are in our Refund Policy, which is part of these Terms. Nothing in these Terms waives a right that cannot legally be waived.
9. Acceptable use
You may not misuse the website, interfere with its operation or security, attempt unauthorized access, scrape or copy catalogs or content at scale, share account credentials outside your household, introduce malicious code, infringe another person’s rights, submit unlawful or deceptive content, or use the service for an unlawful purpose.
10. Intellectual property
The Gradovia Learning name, logo, website design, original illustrations, text, workbooks, downloads, course materials, and other original content are owned by Luis Ernesto Nodal or used with permission and are protected by applicable intellectual-property laws. Third-party names and materials belong to their respective owners.
11. Availability and changes
We may update, replace, suspend, or discontinue features and content. We will use reasonable efforts to preserve paid access for the period or scope described at purchase and to provide a reasonable remedy if we cannot deliver a paid item. Maintenance, security events, internet outages, and third-party services may occasionally interrupt access.
12. Disclaimers and limitation of liability
To the maximum extent permitted by law, the website and educational content are provided “as is” and “as available,” without warranties not expressly stated on the applicable product page. To the maximum extent permitted by law, Gradovia Learning and Luis Ernesto Nodal will not be liable for indirect, incidental, special, or consequential damages arising from use of the service. Any direct liability will not exceed the amount you paid for the product or service giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot legally be limited.
13. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Subject to any consumer right that cannot be waived, disputes will be brought in a court of competent jurisdiction in Miami-Dade County, Florida.
14. Changes to these Terms
We may update these Terms as the service changes. The revised date will appear at the top. Changes apply prospectively unless applicable law requires otherwise.
